As a service provider, we are responsible for the contents of this website according to the general principals. However, we are as a service provider not obliged to monitor transmitted or stored external information or to search for circumstances that could point to an illegal activity.

However, such a liability is only at hand from the point of time of knowledge of a specific violation of the law. Terms of Use

§ 1  Contractual Partner and Subject of the Terms of Use 

  • 0712 UG (haftungsbeschränkt) [Magnolienstrasse 49, 64653 Lorsch], hereinafter referred to as Service Provider, operates the website „Join The Equation - Business Opportunity Marketplace“ (hereinafter referred to as BOM). The General Terms of Use regulate the provision of the BOM by the Service Provider as well as its use by registered companies or entrepreneurs, hereinafter referred to as Users
  • These Terms of Use contain the conditions exclusively applicable between the User and the Service Provider, unless they are amended by written agreement between the parties. Divergent or contrary terms are not acknowledged by the Service Provider, unless the Service Provider explicitly and in writing approves of these. 
  • The User is informed of changes to these Terms of Use by the Service Provider by email. Unless the User objects to such changes within four weeks after receipt of the according notice, the changes are deemed to be agreed upon. As to the right to object and the legal consequences, the User is, in case of a change, informed separately. If a User objects to a change to these Terms of Use, the Service Provider is entitled to terminate the contractual relationship with the User. 


§ 2  Services by the Platform Operator 

  •  The Service Provider operates the BOM under the domains and The Service Provider reserves the right to change at any time the domains via which the BOM is offered. 
  • The BOM is a centralized online marketplace through which companies can introduce themselves by means of a company profile and publish own business opportunities or access such opportunities published by other companies. The BOM’s goal is to bring together offering and inquiring companies and in doing so to facilitate the up-taking of business relationships. Contracts between the individual Users of the BOM are not closed on or via the BOM. 
  • The Service Provider’s obligations are to provide the possibility of use of the BOM as well as to create suitable information- and communication opportunities between the Users (message exchange between Users within the BOM). For this, the Service Provider only provides the BOM to the above described extent as service and especially does not act as representative, agent or facilitator for legal transactions between Users of the BOM. 
  • A User only has a claim for use of the BOM within the technical and operational possibilities of the Service Provider which tries to provide, however, cannot guarantee, an approximately interruption-free usability of the BOM. 
  • The Service Provider does not guarantee the correctness and currentness of any information regarding User profiles, other contents published by the Users and the potential powers of representation/disposal of the respective applicant / User of a profile. 
  • The Service Provider reserves the right to at any time change, expand or discontinue the BOM as well as to exclude certain Users from the use of the BOM.


§ 3  Approval of Users

  • Requirement for the use of the BOM is the approval of the User by the Service Provider after acceptance of the registration application. However, there is no claim for approval. The Service Provider is entitled to reject registration applications without giving any reasons. 
  • Only companies as legal entities or entrepreneurs as natural persons with full legal capacities are eligible to register. The registration of a legal entity may only take place through a natural person with full legal capacities and entitlement to represent. Consumers may not register and are not entitled to use the BOM. 
  • The information necessary for the registration and generation of a user profile must be stated completely and truthfully. The Service Provider is entitled to at any time examine the correctness of the information stated in the user profile using this information; however, there is no according obligation of the Service Provider to do so. The Service Provider does not guarantee that the profile generated by the User really is a lawfully generated profile of the respective company. In case of wrong information, the Service Provider can exclude the user profile with immediate effect from the further use.
  • With approval by the Service Provider (after the registration, the User receives an email with a confirmation link), a contract between the User and the Service Provider is closed regarding the use of the BOM according to these Terms of Use. 
  • The use of the BOM is free of charge. 


§ 4  Users’ Obligations

  • The User must keep all access information to his BOM account confidential and prevent that non-authorized third parties get a hold of the access information. The User assures that all activities on the BOM under his user profile are carried out exclusively by authorized people. The User is liable for every activity carried out with his profile on the BOM according to the statutory regulations. 
  • The User assures and guarantees vis-à-vis the Service Provider that the contents provided by him such as, for example, the stated number of the company, the company logo or other pictures do not violate third parties’ rights (especially no trademark rights, business identifications or copyrights) or breach public morality. 
  • The User is fully responsible for all contents provided by him. The Service Provider assumes no examination of the contents as regards completeness, correctness, legality, currentness, quality and suitability for a specific purpose. 
  • The User assumes the obligation to keep current all information stated in his profile. 
  • The User is himself responsible for backing up his information. The Service Provider does not carry out any data backup regarding the content uploaded by the User and the correspondence carried out through BOM. 
  • By uploading contents, the User grants to the Service Provider a complimentary and transferable right of use to the according content, especially for storing, amending, multiplying and making publicly accessible the contents. 

§ 5  Data Protection

  • As regards the handling of individual-related data, the Service Provider assumes the obligation to comply with the data protection statutes applicable in Germany. The individual-related data collected by the Service Provider is only used internally for administering the user pool, however, not passed on to other Users and/or third parties (except for fulfilling statutory obligations, if applicable). The User himself decides without any influence by the Service Provider, if and which individual-related data he wants to provide to other Users through the communication paths of the BOM. Such individual-related data exchanged between the according Users is used by the Service Provider exclusively for the purpose of transmission to the intended communication partner and is not stored in connection with the user profile.
  • The BOM-websites use cookies (see Privacy Statement ). The User agrees to the use of cookies by the Service Provider, if he does not deactivate the automatic acceptance of cookies for the BOM-websites in the settings of his browser. 
  • Moreover, the Service Provider uses the business information stated voluntarily by the Users (location, branch, products and services of the company) for research and analysis purposes, to be able to propose to the Users suitable business opportunities. Users can at any time request disclosure of the business information stored regarding them. In case of an end of the use relationship, the Service Provider is entitled to continue to use the business information, as long as the User does not explicitly request their deletion. 


§ 6  Liability

  • If the User suffers damage by the BOM through the services provided free of charge and the contents available for access, then the Service Provider is only liable in cases of intent and gross negligence and only to such an extent as this damage was caused due to the contractual use of the free of charge contents.
  • Users are liable themselves for the uploaded contents, especially as regards possible competition law, trademark law, data protection law or other statutory violations. The User indemnifies the Service Provider from and against all claims from third parties asserted due to the violation of their rights or due to statutory violations due to the contents uploaded by User. 
  • As far as there is a possibility via the BOM to being forwarded to databases, websites, services, etc. of third parties (e.g. by uploading links or hyperlinks), the Service Provider neither is liable for accessibility, existence or security of these databases or services nor for their content. The Service Provider especially is not liable for their lawfulness, correctness of content, completeness, currentness, etc. The Service Provider does not embrace third parties’ contents. 
  • The data communication via the internet can according to the current state of technology not be guaranteed to be flawless and/or available at any time. As to this, the Service Provider is liable neither for the content nor for the uninterrupted availability of the BOM. 


§ 7  Contract Duration and Termination

  • The use relationship commences with the approval of the User for an indefinite time. 
  • A termination of the use relationship is possible both for the Service Provider as well as the User at any time. The deletion of the User Profile by the respective User shall be deemed a termination of the use relationship. If the Service Provider wants to terminate the use relationship with a registered User, then this must be imparted to him at the latest with the issuance of the termination in textual form. 


§ 8  Choice of Law and Jurisdiction

  • These General Terms of Use and the legal relationships following there from between the Service Provider and the User are exclusively subject to the law applicable in the Federal Republic of Germany to the exclusion of the UN Sales Convention (CISG). 
  • The Service Provider and User agree as exclusive jurisdiction for all disputes in connection with or arising from the use relationship the place of business of the Service Provider (Darmstadt, Germany). 


§ 9  Closing Provisions

If one or several of the provisions of these General Terms of Use are or become ineffective or void or contain a regulatory gap, then the effectiveness of the rest of these Terms of Use shall remain unaffected. The Service Provider and the User assume the obligation to agree to an effective regulation that comes closest to the purpose the parties intended for the ineffective or void provision instead of the ineffective or void provision.

0712 UG (haftungsbeschränkt) is the provider of the internet platform „Business Opportunity Marketplace“ (hereinafter „BOM“). When using the BOM, personal data is gathered, used and stored exclusively within the legal framework of the German Federal Data Protection Act (BDSG). This Privacy Statement informs the BOM platform’s users about the manner, extent and purpose of the gathering and use of the personal data.

Gathering of General Information

With every access to the BOM-platform’s website, general information – so-called server-log files –automatically is gathered (type of web browser, operating system used, domain name of the internet service provider, IP-address). This information accrues mandatorily and is technically necessary to correctly deliver the content of internet pages that the user has requested. The general information gathered by us in this manner is not used by us in an individual-related manner. 


Gathering and Processing of Personal Data 

We gather personal data only if you as user of the BOM voluntarily provide it to us, e.g. as part of the BOM registration (see sub-item below), by filling out the contact form or by sending messages / emails through the activated BOM account. 

We will only use personal data provided by you to be able to fulfil our contractual duties to you. As regards other purposes, we will use the personal information provided by you only, if you have before hand explicitly agreed to the according use.

Registering for the Business Opportunity Marketplace

Registered users can access contents and services that are only offered to registered users. For a registration for using the BOM services, personal data of the registering person is gathered (name, surname and email address). As a registered user, you can at any time change or delete the personal data you have stated through the BOM profile. 


Data Security

When transmitting data through the internet, the safety of your information is protected by means of SSL-encryption with HTTPS. Nonetheless, we would like to point out that a complete protection of your information from access by third parties cannot be guaranteed.



Cookies are used when using the BOM. Cookies are small text files that contain information and are deposited on the user’s device. 

We only use so-called „session-cookies” to verify the account of the registered BOM user and to facilitate access to the BOM’s web pages. Session cookies are automatically deleted after leaving the BOM website or are automatically deleted after closing the internet browser. 

Apart from that, cookies are only used on the BOM platform as part of the web analysis services used and, if applicable, when using the social media buttons (for this, see the following points of the Privacy Statement). 

Of course, you can reject the use of cookies. For this, you have to in the settings of your internet browser generally exclude the automatic acceptance of cookies or for specific websites. When completely deactivating cookies, the functionality of the BOM may be constrained.

Google Analytics

We use the web analysis service Google Analytics by Google Inc. (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). Google Analytics also uses „cookies“ text files that are stored on your computer and that enable an analysis of your use of the website. The information generated by the cookie regarding the use of this website is usually transmitted to a Google server in the USA and stored there. 

However, In case of an activation of the IP-anonymization on this website, your IP-address is previously reduced by Google within member states of the European Union or in other contract states to the Agreement on the European Economic Area. Only in exceptional cases is the full IP-address transmitted to a server in the USA and reduced there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on your website activity and to provide further services to the website operator connected to the use of the website and the internet. The IP-address transmitted by your browser as part of Google Analytics will not be merged with other Google data. 

You can prevent the storage of cookies through an according setting in your internet browser software; however, we would like to point out that in such case you may not be able to fully use all functions of the BOM. In addition, you can prevent the gathering of the information generated by the cookie that is related to your use of the website (including your IP-address) as well as the processing of this data by Google by downloading and installing the browser plug-in available under the following link (

Use of Microsoft Application Insights

We also use Application Insights, a web analysis service from Microsoft Corporation (One Microsoft Way, Redmond, WA 98052-6399, USA). 

Application Insights deposits a cookie in your browser that enables an analysis of your use of the BOM platform. The information generated through the cookie regarding the BOM use is usually transmitted to a Microsoft server in the USA and stored there. On behalf of BOM, Microsoft will use this information to evaluate your use of the BOM platform, to compile reports about your website activity and to provide further services to the website operator connected to the use of the website and the internet. You can refuse the necessary placing of a cookie – through the settings of the internet browser by which the automatic setting of cookies is generally deactivated of be adjusting the browser in such a manner that cookies from Microsoft are blocked. However, we would like to point out in this case perhaps not all functions of the BOM can be fully used. 

For this, the following additional information is gathered:

  • Display Resolution
  • Approximate Location of the User
  • IP-Address

We have the possibility to evaluate this data through various reports. This data is anonymized statistical data. The creation of a relation to an individual is not possible based on this data. The purpose of the evaluations is the error correction and optimization of the website and its use.

Social Plug-Ins

The BOM provides to its users the possibility of using „Social-Media-Buttons“. These Social-Media-Buttons are only incorporated on the BOM as a graphic that contains a link to the according website of the button-provider (e.g. Facebook, Twitter). Only by clicking on the graphic are you forwarded to the according service of the respective provider (e.g. Facebook, Twitter, LinkedIn). Only then is your data sent to the respective provider. If the user does not click on the graphic of the Social-Media-Button, then no automatic exchange between the user and the respective provider takes place. Information on the gathering and use of your data in social networks can be found in the respective terms of use and data protection declarations of the according providers.
